Terms and Conditions for FoodZtop

1. Acceptance of Terms

Welcome to FoodZtop ("we," "us," "our," "the Company"), operated by PT FoodZtop Indonesia. These Terms and Conditions ("Terms") govern your access to and use of the FoodZtop website (www.foodztop.com), mobile application, and related services (collectively, the "Service").

By creating an account, placing an order, or accessing our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Orders and Payments

  • Placing Orders: You can place orders for dine-in, pickup, or delivery through integrated third-party services (e.g., GoFood, GrabFood, ShopeeFood). All orders are subject to acceptance and availability.
  • Pricing: Prices are as listed on the Service and are subject to change. We are not responsible for pricing, typographical, or other errors.
  • Payment: You agree to pay all charges incurred under your account. Payment is processed through secure third-party payment gateways. By providing a payment method, you represent that you are authorized to use it.

4. Delivery and Pickup

Delivery services are provided by third-party partners. Their terms and conditions apply to the delivery portion of the transaction. We are not liable for delays, mishandling, or other issues caused by the delivery partner.

5. User Conduct

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Infringe upon the intellectual property rights of others.
  • Harass, abuse, or harm other users or our personnel.
  • Use the Service for any fraudulent or misleading purpose.
  • Interfere with or disrupt the integrity or performance of the Service.

6. Intellectual Property

All content on the Service, including text, graphics, logos, and software, is the property of PT FoodZtop Indonesia or its licensors and is protected by copyright and other intellectual property laws.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law, PT FoodZtop Indonesia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or use, arising out of or related to your use of the Service.

9. Data Retention and Deletion Policy

  • Data Retention: We will retain your personal data only for as long as necessary to fulfill the purposes outlined in our Privacy Policy, including to provide you with the Service, comply with legal obligations, resolve disputes, and enforce our agreements.
  • 90-Day Retention Period: As part of our standard data governance, we will automatically delete or anonymize personal data associated with an inactive user account 90 days after the account becomes inactive. An "inactive account" is defined as an account with no successful login or transaction activity for a continuous period of 90 days.
  • Account Deletion Request: You may request deletion of your account and associated personal data at any time by contacting us at support@foodztop.com or from FoodZtop App go to Profile, Manage Account, Delete Account.
  • Process Upon Request/Inactivity: Upon receiving a valid deletion request or upon an account meeting the criteria for inactivity, we will initiate the process to delete your personal data from our production systems within a reasonable timeframe, not to exceed 30 days. Please note that some data may be retained in backup systems for a limited period for disaster recovery purposes before being overwritten. We may also be required to retain certain information for longer periods to comply with legal, tax, or accounting obligations.

10. Termination

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Jakarta Selatan.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after any change constitutes your acceptance of the new Terms.
